Privacy policy

This policy explains what personal information CraneX Trucking Inc. collects through this website and in the course of our crane, transport and machinery moving work, why we collect it, who we share it with, and how you can access or correct it.
1. Information we collect
CraneX Trucking Inc. collects personal information directly from you when you contact us or use the forms on this website. The categories we collect are:
- Quote requests: your name, company, phone number, email address, job site address, and the load, access and scheduling details you describe, including any drawings or photos you attach.
- Credit applications: business and billing information, the name, email and phone number of your accounts payable contact, the credit limit and terms requested, the names and contact details of the trade references you provide, and the name and title of the authorized signer.
- Job applications: your name, contact details, city, licence class and endorsements, certifications and experience, and the documents you upload, which may include your resume, certification tickets and driver's abstract.
- Website analytics: basic technical information such as pages requested, referring page, approximate location, browser and device type, and IP address.
2. Why we collect it and our lawful basis
We collect, use and disclose personal information only for purposes a reasonable person would consider appropriate in the circumstances, and only where we have a lawful basis to do so:
- Quote requests: to price and plan the work, confirm equipment and access requirements, schedule and dispatch crews, and communicate with you about the job. Lawful basis: your consent and steps taken at your request before entering a contract.
- Credit applications: to assess creditworthiness, verify the information provided, contact the trade references you name, open and administer a commercial account, and invoice and collect payment. Lawful basis: your consent, given in the application form, and the performance of our account agreement with you.
- Job applications: to assess your application, contact you about it, verify licences, tickets and driving records, and meet our obligations as a commercial carrier, including driver qualification and National Safety Code record-keeping requirements. Lawful basis: your consent and our legal obligations as a regulated carrier.
- Website analytics: to understand how the site is used, keep it working, and improve its content. Lawful basis: our legitimate interest in operating and improving the site.
Where we rely on your consent, you may withdraw it at any time by contacting our Privacy Officer. Withdrawal does not affect the lawfulness of processing done before you withdrew, and where we have another legal basis or obligation to retain a record, the withdrawal does not override it.
3. Where information is stored and third-party processing
Form submissions from this website, including quote requests, credit applications and job applications with their attached files, are transmitted to and stored in a third-party customer relationship management (CRM) system that CraneX uses to manage enquiries, accounts and applications. That system is operated by a service provider on our behalf, and information held in it may be stored on or accessed from servers located outside Canada, including in the United States. While outside Canada, that information may be subject to the laws of the jurisdiction where it is held, including lawful access requests by foreign courts, law enforcement and government agencies.
This website loads web fonts hosted by Google on every page. When a page loads, your browser makes a request to Google's servers, which transmits your IP address and basic browser information to Google. That transfer happens automatically as part of loading the page and is separate from any information you choose to submit through a form.
We use commercially reasonable administrative, physical and technical safeguards to protect personal information in our custody or control, and we require service providers acting for us to provide comparable protection. No method of transmission or storage is completely secure. Do not send banking details, payment card numbers or other financial account information through the forms on this website.
4. Who we disclose to
We may disclose personal information to:
- Our own employees, operators and dispatch staff who need it to perform or schedule your work.
- Subcontracted carriers, crane operators and riggers engaged to perform part of your work.
- Service providers acting on our behalf, including our CRM provider, email and website hosting providers, and IT support.
- The trade references you name in a credit application, and credit reporting or credit assessment agencies, where you have authorized us to contact them.
- Our insurers, brokers, adjusters, auditors, accountants and legal advisors, including in connection with a claim or incident.
- Government and regulatory authorities where required or permitted by law, including in connection with permits, commercial vehicle safety and National Safety Code obligations.
- A party to a proposed or completed sale, financing or reorganization of our business, subject to appropriate confidentiality protections.
5. Retention
We keep personal information only as long as necessary to fulfil the purposes it was collected for and to meet our legal, insurance, tax and regulatory obligations. Certain records carry mandatory retention periods that we cannot shorten, including driver qualification and driving records required of a commercial carrier, hours of service records, and incident, claim and insurance files.
Where a record is no longer required for a purpose described in this policy and is not subject to a mandatory retention period, we destroy it or remove the information that identifies you.
6. Privacy Officer and how to contact us
CraneX Trucking Inc. has designated a Privacy Officer who is accountable for our compliance with this policy and with applicable privacy law. Address privacy questions, access requests and correction requests to the Privacy Officer at info@crane-x.ca, or in writing to Privacy Officer, CraneX Trucking Inc., PO Box 877 Station A, Abbotsford BC V2T 7A2.
Please do not send privacy requests to our dispatch address; dispatch cannot action them.
7. Your rights over your information
On written request to our Privacy Officer, and subject to the limits set out in applicable law, you have the right to:
- Access: receive a copy of the personal information we hold about you, and be told how it has been used and to whom it has been disclosed.
- Correction: have inaccurate or incomplete information corrected.
- Withdrawal of consent: withdraw any consent you have given, with effect going forward.
- Erasure: have your information deleted where it is no longer needed for the purpose it was collected for. As a commercial carrier we are required to retain driver records, safety and incident records, insurance and claims files, and financial records for prescribed periods, and an erasure request cannot override those obligations; where that applies we will tell you in writing.
- Restriction and objection: ask us to restrict how we use your information, or object to a particular use, while a request or complaint is being resolved.
- Portability: receive information you provided to us in a commonly used, machine-readable format, where technically feasible.
We respond to requests within the time limits set out in applicable privacy legislation and will tell you in writing if we are unable to fulfil a request and why. To protect your information, we may ask you to confirm your identity before we act. In limited circumstances the law permits or requires us to withhold information, for example where it would reveal personal information about another individual or is subject to solicitor-client privilege. We do not use your personal information for automated decision-making or profiling that produces legal or similarly significant effects, and we do not sell personal information.
8. Complaints
If you have a concern about how we have handled your personal information, contact our Privacy Officer at info@crane-x.ca first. We will acknowledge your complaint, investigate it, and tell you the outcome in writing.
If you are not satisfied with our response, you may escalate your complaint to the Office of the Privacy Commissioner of Canada, or to the Office of the Information and Privacy Commissioner for British Columbia, depending on which legislation applies to the information in question. If you are in the European Economic Area or the United Kingdom, you may also lodge a complaint with your local data protection supervisory authority.
9. Applicable legislation
This policy is intended to comply with the Personal Information Protection and Electronic Documents Act (PIPEDA), which applies to personal information we collect, use or disclose in the course of commercial activity across provincial or national borders, and with British Columbia's Personal Information Protection Act (BC PIPA), which applies to personal information we handle within British Columbia, including employee and applicant information. Where these statutes impose different requirements, we apply the standard that provides greater protection to the individual.
Where personal information of an individual located in the European Economic Area or the United Kingdom is processed, we apply the principles of the EU and UK General Data Protection Regulation (GDPR) to that processing, including the rights described in this policy, and we rely on the lawful bases identified in section 2.
10. Changes to this policy
We may update this policy as our practices, service providers or legal obligations change. The current version is always posted on this page with its effective date. Material changes take effect when posted.
